Terms

These terms apply when you create a Finality account or use the service. Finality is operated by ThreeMinds Collective LLC.

Agreeing to these terms

By creating an account or using Finality, you agree to these terms. If you are using Finality for a company or a client, you are confirming you may agree on their behalf.

What Finality does

Finality measures audio you upload and reports what it found: loudness, clipping risk, clarity, tonal balance, noise, dynamics and release readiness, with the moments worth going back to. For lanes with a published submission specification, it reports each published requirement as met, not met, or not measured.

On request, Finality can also return a corrected file. It is produced as an additional file alongside your unchanged original, and every value it altered is reported against the measurement you were shown.

What Finality does not do

Finality does not publish, distribute or deliver your work. It does not replace a mastering engineer, a DAW, or your own ears. It does not guarantee that a platform will accept your file, and it does not guarantee commercial success.

Nothing in your audio is changed unless you ask for it, and your original is never replaced.

Your account

Keep your sign-in details to yourself, and tell us promptly if you believe somebody else has access to your account. You are responsible for what happens under it.

You can close your account at any time by emailing us.

Plans, payment and cancellation

The Community plan is free and includes a monthly allowance of review minutes. Paid plans add a larger allowance and a longer retention window.

Paid plans are billed in advance through Stripe and renew automatically each billing period until you cancel. You can cancel at any time from the billing portal in your account settings.

Cancelling stops the next renewal. It does not refund the period you are already in — your plan stays active, with everything it includes, until that period ends. We do not currently give partial or prorated refunds for time left on a cancelled period.

If we change the price of a plan you are on, we will tell you before the change takes effect, with enough notice for you to cancel first.

Your content stays yours

You keep ownership of everything you upload. You give ThreeMinds Collective LLC permission to store, process, analyse and display that content only so far as is needed to run the service and give you your results. That permission ends when the content is deleted.

No publishing or distribution rights transfer to Finality, ever.

What you agree not to do

Upload only audio you own or have permission to use. Do not upload unlawful, infringing or abusive material, or somebody else's private recordings without their permission.

Do not attempt to break, overload or probe the service, gain access to accounts that are not yours, or share access links issued to you.

Feedback

If you send us suggestions or bug reports, we may act on them to improve Finality without owing you anything for it, unless we have agreed otherwise in writing.

Availability and disclaimers

Finality is provided as-is and as-available. We do not promise uninterrupted service, and features may change.

Finality's results are measurements and guidance, not guarantees. You decide what to release, and you remain responsible for listening to it, for clearing rights, and for meeting the requirements of wherever you are publishing.

Limitation of liability

To the maximum extent the law allows, ThreeMinds Collective LLC is not liable for indirect, incidental, special or consequential losses, or for lost profits, arising from your use of Finality or from relying on its guidance.

Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim.

Suspension and termination

We may suspend or close an account that breaks these terms, creates a security or legal risk, or puts the service or other people using it at risk. Where it is reasonable to do so, we will tell you first and give you a chance to put it right.

If we close a paid account for a reason that is not your fault, we will refund the unused part of the period you have paid for.

Governing law

Finality is available throughout the United States. These terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-law rules, and any dispute that reaches a court will be brought in the state or federal courts located in Kentucky.

Naming one state here decides which law reads this agreement. It does not limit who may use Finality, and it does not take away any right you have under the consumer-protection law of the state you live in.
